Is cursing in public iilegal if you are on your porch not talking to the person that feels offended?

yes but i almost got arrested for that today they told me that it is alaw and it is disorderly conduct a girl was getting out of her car and had kids there in the car and she felt offended

  1. Cursing is NOT illegal. There was a famous U.S. Supreme Court case in which a women called a police officer an "A$$hole" and was arrested for disorderly conduct. The U.S. Supreme Court overturned her conviction and explained that vulgar language/swearing/cursing is protected under freedom of speech. Also, police officers are specially trained to "take" vulgar words thrown at them. So you can legally go up to a police officer and call him a N-word, a$$hole, f***er, etc. The idea is a police officer should be trained properly and remain calm. However, I don't recommend trying that!

    Just because it is unconstitutional to convict someone for swearing, doesn't mean an ignorant police officer cannot arrest you. So if the officer HAD arrested you, it would be an unconstitutional/illegal arrest and you would have simply retained an attorney and had the attorney explain to the court that it is unconstitutional and bring up the famous Supreme Court case regarding that issue.

    Honestly though, I don't even think a DA would press charges in that situation. It is general knowledge nowadays that swearing alone is not criminal. Police officers may be ignorant and not know the law (Remember police officers are not required to get a bachelors degree, let alone a law degree). but prosecutors and judges will.

    I saw a case on TV recently in which a women cursed in walmart. She said "I can't find any f***ing batteries" The police officer arrested her for disorderly conduct. However, they had a brilliant civil rights attorney explaining to the commentator how it is unconstitutional to arrest someone for swearing.

    Swearing in public may be socially taboo, but it is not illegal. Just because a police officer tells you something doesn't make it true. POLICE OFFICERS ARE ALLOWED TO LIE TO YOU! He lied and told you it was illegal so you won't swear in public anymore. Also, many police officers are narcissistic control freaks so they enjoy throwing their weight around.

    There are a lot of people that don't know the law and their civil rights so they will do and believe whatever a police officer tells them.

    And always remember, you have a right to remain silent and not say anything to a police officer. However, in certain jurisdictions you are sometimes required to give your name. So if a cop comes up to you and starts asking questions, you can simply walk away. If they insinuate in any way that you have to stop and come and talk to them, then your civil rights kick in and you have all kinds of rights guaranteed by the constitution. Then, they only have a certain of time before it becomes an automatic arrest, then you have a right to an attorney.

    Don't let those police officers bully you around! If you have any quesitons about the law, ask a defense attorney, NOT a police officers. Afterall, police officers are allowed to lie.

  3. There is no enforcable law that specifically prohibits cursing on a porch.  Instead, there are general laws about disturbing the peace and such that may or may not apply to your situation.
