Is deportation considered a criminal offence?

Basically my boyfriend was deported from the United States over two years ago for over-staying his vistors visa. He was caught and was put in jail for 2 to 3 months (while they filled the plane with other costa ricans). I would like him to come and visit me. Before we proceed, I need to know if deportation is considered a criminal offence.

  3. Overstaying a Visa is a Criminal offense.  Deportation is the punishment for breaking the law.

  4. No, illegally being in the country is...staying past your visa therefore is criminal.

  5. Being deported from the United States would not in itself be a criminal offence for Canada. However, that being said on the Visa application for Canada there should be a question about prior problems entering any Country. He would need to be honest on that count. The question reads "Committed, been arrested or charged with any criminal offence in any country?" He would need to explain the circumstances of his deportation from the U.S. Check out the CBSA website for more info.

  6. Deportation is the penalty for a criminal offense.  Most countries will not allow visas to those who have already violated immigration laws in another country.  The reasoning is sound.  It's because he is likely to violate immigration laws in their country too.

    Let me correct an error, too.  He was not told that he can return in 5 years.  He was told that he is eligible to APPLY for a visa in 5 years. (5 year ban)  It is unlikely that he will ever be granted a US visa.

  7. Deportation is the consequence for committing a criminal offense.  Your bf committed felonies (visa fraud, and overstaying a visa), thus he was deported.  He could have also been fined up to $10,000 on the visa fraud, and/or jailed longer than the few months of immigration detention he got.

    You can go visit him.  He is not coming back here, or he faces up to 20 years in prison.

  10. deportation is the punishment for overstaying the visa in conjunction, with the incarceration, I doubt he will get back in legally,he has lost his privilege to visit the u.s.!
