It is illegal to drive under the influence in all states. However, some states allow one open container of alcohol per adult, in a vehicle.

Most states ( although I dont think all of them do this) have a legal limit of.08 for DUI. I am not sure if any states are left that let anyone under 21 years old drink alcohol. In Illinois, any amount of alcohol in your system under the age of 21 and you are busted.
