  1. No, it is not. It is dependent on the type of plan. If it is an ERISA regulated plan, there are different guidelines effecting it. Even then, the eligibility can be different based on the plan. I have 15 states and four different plans--eligibility requirements differ for three of them according to their collective bargaining agreement.

  3. If it's welfare medical insurance - medicaid - yes.  If it's private medical insurance, sort of.  See, each company can make their own eligibility rules, but the state insurance commissioner can make them change them, if they think they're illegally discriminatory, for example.

    That's why, in one state, the eligibility for a dependent is different, if the parents have different employers, and they have the group health plan.
