if the courts give you a fine and put 3 points on your drivers licence after challenging a mobile phone ticket in court, does that mean you have a criminal record?

  1. No...............

  2. If a court imposes a fine, as opposed to you paying the fixed penalty, then you are guilty of a criminal offence and you now have criminal record.

The conviction will eventually become "spent", so that you are not obliged, in most cases, to disclose the conviction. The period of time before it becomes "spent" depends on the severity of the fine.

Regardless of this, the conviction will remain on your licence for ten years from the date of the judgement of the court.

That is why it is not sensible to challenge a fixed penalty notice without an excellent chance of winning your case.

  3. Only on the driving and transport section.

  4. No..........
