Is getting a speeding ticket 20 mph over considered reckless driving in WI?

It was on a US highway. I'd like to know for court and insurance premium purposes. Also any knowledge of how much this would affect my insurance premiums going up would help.

  1. There's no bright line for reckless driving. It all depends on the conditions at the time. If the officer only cited you for speeding, then that's all you'll get. To avoid increased premiums, do traffic school if available.

  2. As far as premiums go, call your agent.

  3. Maybe.  If you were not cited for reckless driving then no.  Citations for driving 20 over, regardless if a US highway or not, is more common than you think.  I also don't believe insurance will see this as reckless driving.  Below is the Wisconsin statute on reckless driving.  I don't see solely driving 20 over fitting here without other circumstances.

346.62 Reckless driving. (1) In this section:

    (a) “Bodily harm” has the meaning designated in s. 939.22 (4).

    (b) “Great bodily harm” has the meaning designated in s.939.22 (14).

    (c) “Negligent” has the meaning designated in s. 939.25 (2).

    (d) “Vehicle” has the meaning designated in s. 939.22 (44), except that for purposes of sub. (2m) “vehicle” has the meaning given in s. 340.01 (74).

    (2) No person may endanger the safety of any person or property by the negligent operation of a vehicle.

(2m) No person may recklessly endanger the safety of any person by driving a vehicle on or across a railroad crossing in violation of s.346.44 (1) or through, around or under any crossing gate or barrier at a railroad crossing in violation of s. 346.44 (2).

    (3) No person may cause bodily harm to another by the negligent operation of a vehicle.

    (4) No person may cause great bodily harm to another by the negligent operation of a vehicle.
