I am planning to open a store in downtown and i wanted to buy brand clothes and retail it. I am planning to buy them from wholesalers. And i was wondering if it is legal to use the brand name as my store name. For example i buy jack jones jeans from wholesalers and i only sell jack jones and i name my store jack jones. if all the products are legal would that be okay? and what if i use their logos as well?

Also i was wondering how i become distributor or franchisor of any brand company such as DKNY or jack jones etc. I am really interested in DKNY. but i can't find any information on their franchiser requirements or start-up costs or franchiser fee. I wrote them e-mail but no reply. So i am stuck. So it would be really wonderful if you help me with this.

  1. not with out the consent of that co. brand names have registered trademarks

  2. No, it is not legal unless you are part of the franchise and my guess is that very few stores are being admitted to the DKNY franchise as most of the stores are part of the direct company. Sorry but I don't know about how to become a distributor. Why not sell both under your own name?

  3. The brand name your stealing, that company can sue you- so I would make up a custom name

  4. No, you would have to contact the company for information on franchising. They may not franchise. Also, what would you do if you wanted to carry other brands of clothes?  You need to contact a local chapter of the SBA http://sba.gov for information on requirements in your state.

  5. no

  6. im pretty sure that no... thats plagiarism

  7. It is not legal. The brand name is a trademark that is copyrighted by another company. You need to come up with your own original name and copyright it yourself.

  8. officially no, before adopting a make you should contact first the original or the proprietor of the brand, normally they have office for that, that's why they are big makes. they won't allow you to make competition with them. it is to do with their own image and prestige, but if you buy their goods directly your records would be registered to theirs so in case of issue you have the proof that they accorded you to use their make. in any case if you use their make you are making a publicity for  their success, but if it is  a counterfeit you will have the counterfeit representatives on your back and the damage they ask you it's not worthy it will cost you your capital.

  9. do it fearlessly. nobody stops you. i have done it. best luck

To become a franchiser for someone that large, you would need alot of money and a lawyer to approach them
