Is it Illegal to get into email accts?

My husband and I are going through a divorce and I have some emails but not a whole lot to prove infidelity. I don't know his password but I do know all his security information to obtain/change his passwords through the lost password links on yahoo. I am in WA state if that info is needed. No I would not write any emails or change any information (well besides the password through the lost password link on yahoo), just read the emails.

  1. E-mail is treated with the same privacy rules as regular mail.  You do not have a right to read his e-mails.  Consult with your divorce attorney before trying or you might end up needing him for a criminal charge.

    Technically it most cases it is illegal,e-mail is treated the same as regular mail and is supposed to be opened and read by the addressee only.

    Some courts allow the admission of e-mails that prove infidelity,but if you change his passwords,he will know that you got into his accounts.

    He then could change his passwords or switch to another internet provider,delete the e-mails you have and claim you created phony e-mails.

    If e-mails are treated as regular mail,he could file a complaint with the post office and you could end up in federal prison.

    The e-mails have to have enough to prove infidelity,just because he is making electronic goo-goo eyes with another woman doesn't prove your case.

  5. Definitely unethical and immoral. Nothing gleaned from them would be admissible in court. Take the high road.
