Yes it is. They can advertise, but not necessary to employ any one out of the company.

It depends on the grading for the job. There are certain jobs that companies don't have a legal obligation to advertise externally for.

Most jobs, however, have to be advertised out with the company, though there is no obligation to employ the external candidate.

there re a lot of questions here regarding what companies can and can't do. this is free enterprise baby!

government agencies have more requirements and projects dealing with government contracts have some as well, but in general, if you own a company you can pretty much run it the way you want-as long as you abide by labor laws.
