Is it a moving violation to drive in the carpool lane in CA? Do you get a point for one?

  1. Yes, it's a moving violation, because....your vehicle is moving.

    And yes, you get points.

    And depending on how the cop feels that the driver is being a jerk; you could also get ticketed for failure to obey state signs, improper driving, obstruction of traffic (you're a non carpool car, in a carpool lane, meaning...you're making things worse for carpoolers). Etc.

    They also have cameras that take pictures of cars in that lane, and can just mail you a ticket if they see you driving there without extra passengers.
