It depends what type of fraud - if it was working and claiming DSS then its a fine depending on how much, if it was theft then it is a jail term - Scottish Law.

Lets just say it SHOULD be a prison sentence but if we are all honest and your are in the UK,  

They will probably fine you, give you community service and make you pay back the money.

Being CHARGED with any crime doesn't get you prision time.  CONVICTIONS can.

And if one is convicted, yes, it could mean prision time, or probation, depending on the nature and extent of the crime, and the history of the convict.
