Is it a violation when a retail store.....??

Question

in Texas don't have water since Sunday and it's open for business. The customers and employees could not use the restrooms nor wash their hands. This Monday, the city Water Department came but they were not able to fix it.

It can be argued that if customers use the restroom than an immediate health risk is imposed if adequate hot water and soap are not available for sanitary reasons.  However, do not count on any lawsuits from this.  There is really nothing that will be fined unless the facility is a restaurant.
