It is definitly against code to have a bath tub drain hooked up as indirect waste. you need a p-trap to prevent build of sewer gas and code calls for bathtub to be a direct waste hook up.see national plumbibg code for sizing and rules plus check local town ordinces with your plumbing inspector

  5. the reason why you have a 'p' trap in a bathtub, sink, etc is for safety.  The 'p' trap always has a little water in it, enough to keep gases out of your bathroom(sewer gas).  Most basement floor drains have a 'p' trap in them also, but do  you really want to go all the way to the basement, disconnect your plumbing, and then retrieve the hair clog that'll inevitably build up?  probably not.  You can do anything, but I'd strongly suggest that you at least have a 'p' trap....also, if your talking like just having a pipe that hovers above your basement floor drain....I wouldn't do that either, as someone else mentioned the bugs will love you...that and if the floor drain ever gets plugged and you don't realize it, you'll handily flood your basement
