Is it against the law for a c.card comp. to speak to my mom about my account w/o my permission?

A credit card company called my in-laws house and spoke with my mother-in-law about our credit card account. Isn't this illegal?

  1. What you describe is technically Third Party Disclosure.  Depending on what they disclosed, it could be illegal.  Regardless of what they said, it is sue-able.  If you can convince a court that it indeed happened (not easy), then you can sue for damages.  If you can convince a supervisor at the cc company, they may agree to restructure or even write off the debt (if you are convincing enough) to placate you.


  2. Is she in anyway involved with your card? Credit reference, etc. If so, yes they can. They may not speak in detail but they can inquire as to employment status or your phone number, or current place of employment and anything pertaining to them. They may not threaten, ask for money or declare them libel in anyway other than as cosigners, if they did indeed cosign for the card.

  3. most definitely. they are not allowed to discuss even one little detail of your account w/ anyone who is not you. big problem.

  4. If you put your mother-in-law down as a reference on your insurance card application, then no, they do not need your permission, because you have already in a sense granted it when you used her name as a reference.
