Is it better for a case to be DISMISSED or EXPUNGED?

This is what I understand the difference to be:

A case being dismissed means you are not being prosecuted where as a case being expunged means you have been convicted but the judge has erased the record.~

  1. Expunged does NOT mean the record does not exist any more.  There is no erasure of the records.

  2. A case that is dismissed simply means that the evidence to prosecute is not complete. The case can be brought back to trial when all of the evidence is compiled to prosecute.

Expunged means you paid your debt - you lived a good life and the past criminal record is erased.

I would rather have a record expunged then to be looking over my shoulder each day.

  3. Dismissed, mostly due to decreased cost, time, and trouble.

  4. Dismissed.

  5. I would be happy with either one.  It sure beats guilty.

  6. expundged is like being forgiven it will not show up on court order or if someone looks for convictions but it will be in your court file that it was expundged. Dismissed is as you thought
