Question:

Is it better to get married in the US or in Honduras?

My boyfriend is from Honduras and we are trying to figure out how it would work best for us to get married. I know about the fiancee visa but I have heard that it is very difficult to get and that afterward the visa-holder has to leave the US or be illegal while waiting for his green card. My boyfriend would also like to attend university, so would it be possible for him to get a student visa and marry me here while he is studying? We just don't know the best and easiest way to be able to get him into the US. I have heard that it is very difficult to get any visas before the marriage and some people have said it would be better for us to marry in Honduras and live there until he gets his green card. It would be fine for us to live in Honduras, but we would like to know the best way to go about all of this. Does anyone have any experiences with the student visa or fiancee visa? Or any knowledge of if it actually is easier marrying in a foreign country and then moving to the US?

  1. If he lives in Honduras (not illegally in the United States) it will be relatively easy to get a fiance visa for him.  After he comes here you have 90 days to get married.  After you get married he will simply adjust status and stay and live here.

If he lives in Honduras you can easily go there and get married.  You will come back, alone, and file the papers for him.  It will take anywhere from 6 to 12 months for him to get his US immigrant visa.

To come here as a student he first has to get enrolled as a student in a US college or university.  The school will send him a form called I-20.  He can use the I-20 to apply for a student visa.

He'll be required to PROVE he can support himself, and pay for his education, in the USA without working or he won't get the visa.  He'll also have to PROVE he will return to Honduras after he's finished with school.  This is NOT a good option for you two.

  2. stay in honduras and build a life...
