Is it cheaper to use a process server or the sheriff's department?

how do they determine the cost--and are you able to mail the papers to whoever is to serve them? i don't anticipate any problems with the business to be served.

ALSO--we're suing in small claims for property damage. i only put my name as the plaintiff. my husband is on the deed. is he required to be named as plaintiff too? we're in california

    Dept. I've been a Process server before the Sheriff's Dept

    charges a lot more

  3. most likely your spouse would need to be on the petition, unless maybe if it is community property state. that is not my state so i do not know the answer for you for certain

    call the court clerk and ask them about service. they should be able to tell you how it is done, and then you can call private process servers and ask for prices.

  4. The sheriff's service fee is set by law.  Look it up on their website or ask the clerk of the court.

    You can shop other process servers.  Look them up online or in the yellow pages.

    Since both of you are damaged and the property is probably community property, both your names could have been included as plaintiffs.  Call the clerk of court to ask about filing an amended petition to correct this, if necessary.  Is there a reason your husband was not included as plaintiff?
