Is it child endangerment in the state of Tennessee to have children in car and no insurance?

my husbands ex has no insurance, and is fixing to go to court the 2nd time for not having it when she has had a accident. We are trying to find out if we can stop her from driving with the kids till she has it.

  1. It is not child endangerment unless her driving is such that she is putting the children in imminent danger. If she is not driving dangerously, insurance or the lack of has no bearing on the safety of the children.


  2. I expect it is illegal to drive without insurance. That is aside from it being not very smart. I don't know if it would fall under child endangerment though.

  3. No but I understand what you are saying and what I would do is contact the cps department and notify them of this and your concerns for the children's safety and I would say that they help you out and put a stop to this.

  4. No, not child endangerment. It is illegal to drive w/out insurance, but as far as stopping her from driving with the kids till she has it? You would probably have to get an atty and start filing motions etc... (lot of time and money for this).

    Unfortunately this is about the only recourse you would have legally and I wish you the best of luck.
