Is it committing Insurance Fraud when Your keeping Insurance check for yourself, and making someone else pay?

I got into a car accident at work, and at first the agreement was for me to pay half, and the other drivers insurance company was going to pay the other half. Then all of a sudden it changed to me paying the whole thing. I agreed, but later in the mail i got a letter from the insurance company saying i owe them money. I called wondering why i would owe them money when i was supposed to be paying for the whole thing out of my pocket. Then they told me that they sent the other driver a check to pay half of the car. So my question is, is it committing insurance fraud by keeping a check from your insurance company that's supposed to be paying for the car, and making the other party pay for the whole thing. and also if i can get out of paying any amount because she is committing insurance fraud. Thanks.

  2. Just pay your ins. co. Send the other driver half, with a note that, since she already received a check from your ins. co. this is all you owe her.
