It depends if you are on about about their physical heart or their heart in love.

If it's their heart in Love then no it's not a criminal offense, although it may lead to a crime being committed by the ones who's heart you have stolen in the form of revenge.

If you are on about stealing their physical heart then I think you are definitely doing a crime. Getting their heart out is without doubt going to require some form of assault or GBH just to get it out, you then have the likelihood that they will die so you will have the crime of murder to deal with too!
