Is it considered vehicular manslaughter if i hit and kill some one that runs a stop sign?

a little while ago i was involved in a car accedent that resulted in the death of another driver. the other driver blew a stop sign, and i hit him. am i at fault at all?

  2. No it would not be your fault at all as long as you were driving correctly and not under the influence of anything, dont worry...

You should feel sad that you killed someone even if it isn't your fault.  Life is precious and I see no sign of remorse or saddness in your inquiry.  This is a cold question.  Legally you are not liable however we are called to drive defensively.  Please do not show this "it's not my fault" mentality into court.  It doesn't play well in front of an audience.

  5. You could be.  There are a lot variables:  the laws in your state, the speed limit, number of lanes on the road, whether drugs or alcohol were involved, and even the weather.  

    There are usually 2 types of law governing liability in a loss, from an insurance co standpoint.  Your state is either a contributory negligence state or a comparative negligence state.  Contributory says if there is even 1% neg on the part of one or both drivers, then one or both drivers is barred from recovery for damages.  Comparative neg is the opposite.  Liability may be shared between both parties and both may still collect damages from the other.  What state do you live in?  Can you offer add'l details of the accident?

    New York is a pure form comparative state.  If the roads were wet, and you were doing the speed limit, it could be argued that you were moving too fast for road conditions.   I do have to wonder how hard you hit the other vehicle to cause an impact great enough to kill the other driver.  You didn't say what the speed limit was.  I also don't know the points of impact on each vehicle.  

    As long as you didn't have any stop sign or traffic light, and the points of impact were not toward the rear or on the rear of the other person's vehicle, then you likely would not be considered at fault.  But bear in mind that you only have to be found 1% negligent in order for the family of the deceased to place a claim against your policy and get a settlement from your policy.  

    I cannot answer as to whether you would be charged with manslaughter or not by the police because those charges are the criminal portion of the accident, where as the claim resulting from the accident is the civil portion of the law.  

    Hopefully, as long as you have insurance, and enough insurance to cover your assets, then you shouldn't have to worry as it's the insurance company's job to protect the insured from any excess judgments concerning bodily injury or property damage.  Hope that helped a little.

  8. nah, i think you are in the clear.  your situation is like you starting a camp fire and some nutbag jumps in it...then tries to blame you for burning them.      I'm pretty sure this is where the bumper sticker slogan "Sh*t Happens" was born.
