Is it discrimation for one person only rentals?

If you are looking to rent a one bed or studio, can you state that only one person can live there if it is not due to building code? Such as, if code allows two people to legally reside on the premises, would it be rental discrimination against a couple to say only one person is allowed?

  1. It is illegal to discriminate based on marital status, so they can't prohibit somebody from moving in based on the fact that they are married or single.  That extends to ummarried couples.   Courts have held that even if the landlord has a religious conviction against unwed cohabitation, the need for housing is greater and within the interests of the public.


  2. I don't believe so. Like, some places don't allow pets, nothing about the building code, they just don't.

    Not the same, but you get the idea.

  3. YES - you cannot limit # of people just because you only want that # of people.  It is discrimination against families when you say that.  You have to allow the max # of people that code allows.
