My understanding is that it's very hard if not impossible to get a conviction on attempted rape. No, I wasn't assaulted in any way. I was thinking about the dangers of being on a cell phone walking alone at night. It happens often, and rapists look for potential victims who appear weak or distracted. If for some reason the attempt was interrupted and the woman had scratched the attacker and was able to get away safely and call the police, would the DNA under her nails be enough for a conviction, or would the guy go free so he can look for his next victim?

  1. People are convicted every day for attempting to rape someone, however it is usually charged as an assault and the attempted rape is not part of the charge unless there was an actual disrobing and an attempt at some form of penetration.~
