Is it fair to ask to get a settlement including the tuition of school?

I was in a car accident last September, I was the passenger so I wasnt at fault at all, and I got a concussion. This was I think my 6th or 7th concussion. Due to the concussion I couldnt complete any school work, and I basically had a learning disabilty until my brain was healed. So during this time I did very poorly, because my brain wasn't exactly in functioning order. The medical bills for $1045 and they didnt pay $150 because it was "excessive". I only went to the ER once right after the crash. Tuition is $5510 per semester and I want to claim that as damages so a total or $14,110. Is this fair?

  1. I think the first step is that you would have to have a doctor confirm why you got poor grades ... that might be hard to prove.


  2. Lots of luck!       You said you only went to the ER once?  Were you under the regular care and attention of a physician after that???? Because unless you were,  the other party is in an excellent position to say "Bull-----!"

  3. Nope, not fair.  

    See, you already had brain damage - see the precident you already listed.  If you were a straight A student before, and you went to an F, well, that's an arguement.

    On the other hand, you can ASK for whatever you want.  But I don't think you're going to get tuition.
