Is it illegal for a company to pay you regular times for all your overtime hours when there's a holdiay?

I get paid on the 15th and the last day of the month, but for example this week im working 10 hours OT. next week I'm working 8 hrs. OT. but since MOnday is Labor day my company will paid me my regular hourly rate instead of time an a half. my boyfriends says its illegal, is this true?

  1. Must holiday time off be paid?

    For non-exempt (hourly) employees, no. An employer does not have to pay hourly employees for time off on a holiday. An employer is only required to pay hourly employees for time actually worked. On the other hand, exempt employees (salaried employees who do not receive overtime), who are given the day off, must be paid their full weekly salary if they work any hours during the week in which the holiday falls. This requirement for exempt employees did not change under the new federal overtime regulations.

    Federal employees are entitled to receive holiday pay for time off. Paid holidays for Federal employees are established annually by the Office of Personnel Management (OPM), based on a "holiday  pay law" that is specifically for Federal employees.



    But, there is no Federal "holiday pay law" that specifically entitles private-sector employees to receive paid holiday time off.

    In fact, there is no Federal law that requires private-sector employers to give employees time off for holidays, whether with or without holiday pay.

    Of course, private-sector employers must pay employees for working on holidays. But, under Federal law, they don't have to pay overtime to eligible workers for holiday work, unless their total work hours exceed 40 in the same workweek.


  2. Depends on overtime agreement.  Do you get OT after 40 hours worked?  Then yes, you are f---ed on overtime with holiday pay.  My husband's company does this too.  With union work, OT pay is after 8 hours, on your unscheduled day, and after 40. Most non union jobs you are left hanging
