Is it illegal for employer to not pay for job training in CA?

I was told to come in for three , four hour shifts at this drinks place called Quickly and during this "training" i preformed every duty that an employee would, literally working, making drinks, servering customers, cash register, cleaning. frying. After the 3 days he states that he has decided to hire me. THe problem is I will not be able to take the job and he thinks that it is not necessary to pay for these days? Please tell me the exact law with link that contradicts this ?

  1. Federal Fair Lagor Standards act is what you are looking for.  There might also be CA laws about it, but the federal law, at a mimimum, must be followed, and it mandates pay for ALL of the hours worked.


  2. i think it would depend on the "rules" the employer set before you began your "training". Was this discussed? Many firms/companies have programs where one must serve OJT time, and whether this is a paid position or not is usually set before training begins. You would have to check with your state unemployment office for specific laws in your state. Good luck.

  3. TRAINING IS WORK HOURS AND AS SUCH MUST BE PAID.

    it does not matter what state you are in if this employer refuses to pay you by the regular pay-day for the pay-period you worked in contact the state department of labor to file a complaint. it does not matter if the employer just now decided to hire you or if you decided to not stay with them they must pay for the time that was worked.

    in California the employer actual only has 72 hours to pay you when you quit but since this whole process got screwed up give them until the normal pay-day as a COURTESY.

    if they jerk you around just file the claim and the state will deal with them they will get you your money along with a penalty in some cases.
