Is it illegal for minors to buy cigaretts?

I know anyone can smoke them and stores arent allowed to sell them to underage kids but if someone that is underage bought a pack because the clerk didnt card them, could that person get in trouble or would only the clerk get in trouble. This is assuming the kid that bought them never lied about this age.

P.S. I just want to know for my general knowledge, I don't plan on smoking or trying to buy cigaretts,

  1. Well where I live, it's not only illegal to buy them but it's illegal to smoke them if you're under 18.  So if you buy them, both you and the clerk will get in trouble.  I live in Nebraska.  I believe the law is the same in Wisconsin where I've lived as well.  


  2. In my state, you must be 18 to purchase, smoke, and be in possession of them for any reason.  Both the purchaser and the clerk would get in trouble.  It's called contributing to the delinquency of a minor for the clerk.

  3. I've seen in stores for myself, two people standing at the counter. One goes to buy cigarettes, they ask for an ID, they don't have it, so their friend standing next to them whips out an ID, and they sell them to the person with the ID.

    However, if the clerk doesn't card them, the clerk and the store gets in trouble. They get fined and banned from selling cigarettes. Next time you go into a store and see empty cases where the cigarettes should be, its because the store got caught selling to a minor.
