Is it illegal for my fiance to buy beer when I am with him?

I am 20 and my fiance is 26. We went to a store and he tried to buy a 6 pack and the lady behind the counter got all up in our faces trying to tell him that he can't buy beer when I am with him. Is that true? I live in Texas and from what I have read if he buys me beer and I am with him then its ok. So why couldn't he buy beer for himself?

I read on this website that a minor can drink if they are with a parent, legal guardian or spouse.

  1. Once your're married, he can buy you alcohol, but not until then.  He is not *technically* your spouse yet.


  2. Not 100%, but I think the lady is correct. Different states have different laws on drinking... I don't know them all... its the same here in Kentucky though. I was with my husband (I'm 20, hes 24), and the lady at Walmart got really bitchy about it when I was there and he was attempting to purchase a 24 pack of beer.

  4. Possible.  In NYS the store can deny your purchase if you are accompanied by a minor.  Many states have similar statutes.

Sounds like a bunch of bull to me:)   I don't know why he can't buy beer for HIMSELF; but buying it for you is a different story.   Since he was buying & paying for the beer, there's no reason they should have even asked for YOUR ID!   And, if they ask, just say you don't have your purse and it isn't for you anyways; and you're not buying it!  (or go stand somewhere else while he pays for it)

  7. The rule is likely in place at the store to protect the store owner - they may be legally allowed to sell him beer in your presence, but they have the right to refuse sale to anyone should they suspect that it's being purchased for a minor.

    A minor may be able to drink with a parent, guardian or spouse, but he's your fiance, not your spouse.

  8. you should just stay in the car and wait till he comes with the beer. okay i  know i sound stupid. but yeah if all you get is beer of course they will get in your face. try to get like alot of stuff like chips, soda, gum ect. but its safe to just stay in the car and wait.

  11. a minor isnt supposed to drink at all and the adult can get into serious trouble because its soliciting to a minor. but if hes buying to for you then you and he can get in trouble but if it was for himself then its not illegal

    Fiance's are not spouse's under law.

Until you're married, it's not okay for you to drink with him (but I imagine no DA would prosecute you, no judge would hear the case, and no jury would convict you).  However, he absolutely can buy beer with you in his presence, and if someone refuses to sell to him, he should ask to speak to the manager or supervisor.  If the situation isn't resolved immediately, on the premises, and the store is part of a chain he should right a letter to the company headquarters detailing the events.  There's no excuse for that c**p, even in Texas.
