Is it illegal to climb a unused, unfilled, rural watertower if i have the permission of the people who own the land its on

  1. Depends on who owns the watertower.


  2. if you have permission of the owners of the tower (and the owners of the land it is on), it would not be illegal in most areas.  

    But you are right it is dumb.  Old steel may look sound but be rusted right through.  

  3. If the people who own the land say it's ok - they can be held liable for any injury or lawsuits that may occur.  The owner of the watertower can also be held liable and be sued for any damages.  The person, if they are caught, may be arrested according to the jurisdiction's laws.

    It's just not a good idea because of the liability issues.

  4. Ownership of the land and ownership of the tower are separate issues.  Who owns the tower?  it is usually a municipality or a private water company.

    If you fall, a real possibility with an abandoned water tower, there are liability issues.  The owner would press trespassing charges to relieve their legal liability if you fell.

  5. If it is their tower, then yes.  If it a municipal then no, that would be trespassing.  So if the gov't owns it, dont' do it.  Otherwise okay.
