Is it illegal in California to record a minors phone conversation with your ex spouse without their knowledge?

I think my ex is recording my conversations with our daughter (age 11) without our permission just to listen to what we say and to try to find out about my personal life. He is a former police officer (now a pilot.) When confronted about it all he says if "if he is recording our calls he ca because its his phone." I feel like this is an envasion of my privacy and am no longer comfortable talking to our daughter when she is there.

  1. In California,  one side has to consent to the recording of a conversation.  If neither side has knowledge or consents to the recording, it is illegal.  (Presuming you are talking about a private party doing the recording, and not Law Enforcement)

    That being said, just because a recording was made legally does NOT necessarily mean it will be admissible in court.  (I am presuming that is the purpose of the recording)


  2. yes it's against the law but your federal government (BUSH )dose it all the time
