    How badly your sentence is when caught depends on how much you are doing. If you sell a couple of fake shirts you will probably get off with a fine and/or community service. if you are importing crates full of fake stuff and selling it on eBay and at markets/pubs on a scale that can make you a living you can easily expect a custodial sentence.

  7. Yes, it is illegal to sell fake goods if you are trying to sell them as the real deal.

    It comes under the counterfit goods act, as for what could happen when you get caught, it rather depends on how much of what you are trying to sell, and of course if you are doing lots of boot sales etc, just how much can be accounted to yourself.

  9. Yes it is illegal, it infringes not only copy right but tax fraud and H&S laws. The punishement varies depending on what it is and how many charges are brought, you could be charged with a number of things eg If you imported a peferfume it could be contaminated in some way, you may be charged with Tax Fraud, Copyright offences and if the product was very shady, reckless endangerment; if this were the case you could be looking at 10 to 15 years.

  11. Unfortunately the penalties can be serious.

    Major financial contributors to New Labour asked for severe penalties for violations of intellectual property rights(copyright infringement).

    Often,this can mean confiscation of the goods themselves,a fine and possible imprisonment if one is found to be operating on a sizable scale.

    The worst is still to come.If one is convicted of this crime,they are open to financial investigation by the Assets Recovery Agency.This government department will investigate the last 6 years of your finances and hope to confiscate all assets that you cant account for under the proceeds of crimes act.

    Even if you can prove where some of your assets are from,if the investigators decide that you have benefitted from crime,they are still entitled to strip assets to that amount.

    eg.your house is worth £200 000.Your benefit from crime is estimated at £200 000.You lose your house even if you prove you inherited it.

    This act is subject to reverse burden of proof.Essentially ,you are guilty until you prove yourself to be innocent.Whatever you dont prove to be innocent will be confiscated.If the courst decide that you have benefitted more than your available assets,then you will lose all of your assets and still owe the courts.You will have 6 months to pay the balance or be imprisoned for an extensive period without parole.After you are released,you will still owe the balance.

    These are the draconian measures introduced by Blair to raise election funds from large corporations.They arent particularly fair and it isnt justice but then I didnt vote for him.

    As a couple of answerers have pointed out,the great unwashed arent entitled to be enterprising.Financial crime appears restricted to the corridors of westminster.
