Honestly, nobody will ever know. You "bought" the DVD and after you backed it up, a couple days later it "broke" and you "threw it out".

If it is YOUR DVD that you own, no, it is not illegal.  If it is a rental, borrowed/friend's etc, then YES, it is illegal.
