  2. not illegal depending on what music you use. use major hits and stuff then the government will want money

  3. It's legal if you use podsafe music, or independent artists who give you specific permission. That's why you never hear a podcast with "popular music". Even your favorite radio station, if they have a podcast, has to take out the music except for the indies. The licensing groups (BMI and ASCAP) Have made it so expensive, even the real radio stations can't afford to do it.

But there are lots of great podcasts that feature music you wouldn't be able to hear on a real radio station because they don't have a label to promote them. You could easily do one of those.

  4. It's not illegal, per se, in that you wouldn't do any jail time, but it would be copyright infringement, and you may have legal consequences. There are plenty of music resources if you do a search on podsafe music. There are plenty of musicians that allow you to use their music, such as David Byrne & Brian Eno's album "My Life in the Bush of Ghosts". But with radio music being in such abundance, unless you focus on local bands, the only people who would listen to a music podcast would be your friends, and you can just make them a mix CD. What would be the point of putting out a music podcast?

  5. yes--unless you plan to pay royalties to the people that made the songs.

  6. Nothing really polishes a podcast more than background music or theme music. In the music world, these music segments are referred to as intros and extros. While many enjoy streaming Internet Audio and recording songs they like over the Internet, these songs cannot legally be used in a podcast.

Podsafe music refers to music specifically for podcasters. The music is licensed in such a way that podcasters can purchase a license to include the music in a podcast without incurring additional fees or expenses. In order to use traditional music that is heard on the radio in a podcast, podcasters may have to pay royalties for each time the song is played. Some music files licensed under public domain or creative commons are exempt from royalties and these songs are available for use in a podcast, but generally when searching for music to include in a podcast it is probably best to stick with music that is specifically designated as "podsafe".
