  1. Yes because that would be an open container in your car with you. You would still get charged with DUI most likely. Or if you're lucky you would get off with an open container ticket. It is illegal no matter if its one or ten.

    The officer would make you pour out the open beer, might give you a ticket for the offense.  If you get the ticket, you driving privileges could be suspended for at least 30 days.

    Drink the beer when you get home!

    As of November, 2007, only one state (Mississippi) allows drivers to consume alcohol while driving (as long as the driver stays below the 0.08% blood alcohol content limit for drunk driving),

  9. Drinking while driving and you will get busted, even if it is only one.  You should drink the beer first, then drive home.  If it's only one beer, the average adult man shouldn't have a BAC high enough to significantly impair judgment.
