Hi all, I know this mite seem like a stupid question but I have to drive this so called vehicle as transport for kids to go to school in as it is my job. My boss has yet to fix the van and I dont really want to drive it in this condition either. Does anyone know if this is illegal or not? I know it is not safe but I have no choice at the moment unless I chuck my job in.

Please help!

Thanks

Maree

  1. Yes it is illegal. You will get a defect notice and a fine.

  2. yes you need atleats a driver side mirror and rear veiw mirror

just go down the car wrecker and pick  a cheap one up

  3. I think it is ok to not have the passenger side as long as you have the drivers side mirror but I would ring the transport department or motor reg to find out if I were you. See if you can get it in writing then take it into your boss and tell him if you get any fines he will be paying for them. Whoever you call let them know you transport KIDS as this could be a different factor altogether. Good luck.

  4. Yes it is. No side mirrors makes it roadworthy!

  5. Hi! Aussie,

I would say yes!, some years back I had a chat to my mechanic who I dealt with for many years and is up-to-date with all the new regulations. He told me if it came out of the factory with it, it has to be on it for rego also if something is fitted and legal it must work or be fixed or removed, this incident was regarding a pair of driving lights I fitted but did not get around to connecting. So for the check I removed them and refitted them and connected them so they would be legal. The matter that concerns you is not only a road worthiness  issue but a O.H.a.S. and would/could involve workcover if you where involved in an accident. To make things worse not only your boss would be held accountable but so would you for knowingly driving an unsafe vehicle.

Check with your local mechanic or R.T.A. or ring workcover, you do not have to give your name, just ask for advise, it's your ar*e on the line.

    Eric.

  6. sure is buddy, i'd get that fixed asap, must make parking easier though.

  7. Yes. If the vehicle was fitted with side mirrors when new, it must be fitted with mirrors at all times. If your worried about your boss, it is illegal for him to force you to drive an un-roadworthy vehicle. Get in touch with your union. Or you can contact Worksafe. The phone number will be in your local phone book.
