I am 20 year old. I live in FL, and the person who has my papers is my mom. She lives in SC. She will not give me them.

  1. It all depends. If it is your child and the child is under 18, then its not illegal. Anybody else other than your own biological child, claiming they want those documents back, then you must surrender them. Or else a judge can hold you in jail until such time as those documents show up.

  2. Ummm, YeS!~~~

  3. Depends. If you're under 18 and it's your parents who have them, then they can do it.

If you are an adult, to heck with the person... just file to request duplicates.

  4. YES! You have the right to your personal papers...they are a requirement to get a job, a passport etc. The only people I know that can hold one for you would be law enforcement while you are in their jail or a caregiver with power of attorney  ...with that spelled out, I think. A hospital when you are incapacitated if there isn't a viable relative to give it to.

You need these documents and need to not waste time arguing about it...go to the law...legal aid if you cannot afford it.

  5. no, but if you use it as your own, it's illegal.
