Is it illegal to possess a pipe in Queensland, Australia?

I have a pipe coming in the mail (a smoke pipe, not a bong or anything) and im rather worried as to whether i can be charged for this, If so; It is an international delivery, and i have not received it, so are police allowed to look through my mail and arrest me before i have received it? Please help.

  1. well first of all the police dont look through every single mail being sent to aus not only that but it has never been used to smoke pot so ther is no residue of the drug,haha u will not get arrested or anything 4 having any kind of pipe u could have a ten foot bong comn ur way and they want do anything as long as it has never been used! the reason is its not elligal to buy pipes or bongs in aus,you live in queensland so im sure u have heard of the condom kingdom in surfers paradise its a bong and pipe shop i bought a bong ther once myself


  2. If i know the type of pipe you are talking about, it is not illegal to possess one but under new Queensland laws it is illegal to display them as certain other substances can be smoked through them. Have you ever thought of spending a trip to Nimbin and all your worries will be sorted. :o)

  3. No. There is no law against smoking tobacco products or against products used to smoke tobacco.  The pipe is just an implement to put tobacco in just like cigarette papers used by people who roll their own. If it were illegal people would not be able to buy pipe tobacco.

    Now of course you would know that smoking is harmful to your health and addictive.

  4. There's every chance you WILL be charged if the police find out you have one - and Customs can alert the police before it even gets to you.

    Here's some relevant snippets from Qld's laws:

    DRUGS MISUSE ACT 1986 - SECT 10

    10(2) A person who unlawfully has in his or her possession anything (not being a hypodermic syringe or needle)--

        (a) for use in connection with the administration, consumption or smoking of a dangerous drug; or

        (b) that the person has used in connection with such a purpose;

    commits an offence against this Act.

    Maximum penalty--2 years imprisonment.

    Cannibis is a "Schedule 2" dangerous drug, meaning if you are caught with 500g or more (or 100 plants or more), you're facing a max of 20 yrs prison, or only 15 yrs for a lesser amount.

    It's obvious to everyone that the pipe is to be used for smoking cannibis - of course you can try to argue that it could be used for smoking tobacco but the cops won't buy it - they will charge you and let you try to convince a Magistrate that you never intended to use it to smoke dope! Good luck with that - just look at the whole setup of the website you bought it from! The cops are going to show the Magistrate all that, and he'll then ask you why you didn't just buy a normal pipe if you just wanted to smoke tobacco? I hope you have a REALLY good answer ready because he's not going to believe you whatever you say.

    Contrary to what the fool Juzy tells you, it doesn't matter whether the pipe has been used or not - the words of the section are whether the thing is "for use" in the consumption of a drug - not whether is has been used. You can tell Juzy knows nothing of the law and has obviously just been lucky so far!

    More info - it was a loophole in the law for quite a while (I believe they've closed it now) that it was not illegal for someone to sell a bong but it was illegal for you to buy one!

    Chances are customs have better things to do.

    If you're caught, you'll probably just get a slap on the wrist - a token fine at the most.
