Sorry buddy.  It isn't legal.  Have your girl wear SOMETHING.  Something s**y maybe, but she'd better be dressed.  Kiddie p**n is still kiddie p**n, even if you're still a kid yourself.

And when you turn 18, you could be tried as an adult if you're caught with it.

Yes, you can be arrested for distribution of child pornography, even if the pictures are of yourself and you are under 18.  There is no exception in the child pornography laws for you sending pictures of yourself.

Different states have different laws. However... if you are both under the age of 18 and within each other in age group I do not think it will be a problem for you. If you are say 17 and your gf is 12, then yes, you could get in trouble. If you are both 16, then I do not think there will be any problems. The person being depicted would in any case not be in trouble with the law, only the person storing the picture. Who would tell the police you had these pictures on your phone?
