Is it illegal to take my kids across state lines?

i may be leaving my husband and many people have told me its illegal to take my kids across state lines if he doesnt give his permission. id rather die than leave my kids with him. is it like kidnapping even if it is my own children?

  1. You can't do it without his permission. However, if you call a lawyer first and file legal separation you may be able to.

  6. You can take your children across the state line ... no problem.  When you try to go across to a different country however it becomes a whole different story.  Now it becomes illegal.

Taking your children out of a 'harmful' or 'emotional' situation isn't illegal,  unless of course you have (or he has ) a Court order stipulating not to do so.  Personally,  If I were in your situation, I would seek counsel upon arriving at your destination to start legal paperwork to insure your position.  As a male, I made this decision myself, I went to Court, and received custody, and visitation for her was at my discretion and supervision.  Last I heard from her was 1982.  God Bless....

  9. Well it depends; do you two still have joint custody or has it already been through courts- and has he gained custody? If there has been no official custody "battle" yet, then it is legal when you have joint custody. If he has custody; then it is considered kidnapping.
