I know they just passed a law where there is a $300.00 fine for texting while driving, but is it illegal to talk on the phone without a headset or bluetooth?

  1. If the law includes texting the most likely it would include talking. Even if it did not you are responsible for yourself, your passengers, pedestrians, and to other cars on the road. This means you must drive with care, obey the laws, and have your attention on the road. In the event you are speeding, hit someone, or have an accident the fact you were driving may affect any decision made. For example a drunk driver hits you but you could have avoided them had you not been on the cell phone. It could be successfully argued that you contributed to your injury by being on the cell phone. Also if you are not paying attention as you drive and hit another car because you are on the phone. You could be held responsible for the accident due to the fact you were distracted on the cell phone.

    So to answer your question is it illegal to talk on your cell phone in Minnesota? The answer broadly speaking is yes due to the fact it can divert your attention from driving regardless if you are using bluetooth and you could therefore be responsible for any damage done as a result of your driving. On a narrow interpretation it is possible that it is not illegal provided it is not stated in any statute and the courts have not interpreted any statute to mean the charge includes using a cell phone.
