Not pay me overtime, when there was no agreement in the beginning and i am NOT on salary?

also.

when he splits my hours from one week onto 2 and some times 3 paychecks over time... instead of paying me for all hours worked on the one paycheck their supposed to go on?

  1. Nope, and nope, he can't do either one, overtime is federal law, and you must be paid for all hours worked, at the end of the pay period.

    Look up the "dept. of labor" on the net.

Yes, it is illegal for these things to happen.  If you copy your time card or time sheet before turning it in you will have proof of your hours worked and then you can sit down and discuss this practice with your boss.  If you do not get satisfaction from him you will need to consider your options.  Do you like or need you job enough to stay on knowing how your pay situation is being handled or do you want to fight what is being done?  

    To fight the illegal practices you need to take copies of your hours worked to the wage and labor division of the employment bureau.  They will contact your employer and represent you to try to straighten things out.  You run the risk of being "laid off" at some point.  It is against the law for the company to fire you over this dispute; however, many times a company will find an excuse to let an employee go after something like this has happened.

    I hope you can successfully straighten this out with the boss because I don't think anyone should be taken advantage of in the work place.  Jobs may be hard to find; however, that is no excuse for abusing the employer - employee relationship.  You have rights and you need to stand up for yourself.

    PS   It is not necessary to check with your state's statutes,       this is covered by Federal laws.

  4. Yes, this is illegal and should be reported to the labor board. They should have a toll free number and you should be able to report anonymously. They may even have a website you can report on. It will be hurting you if you don't report it, he's cheating you out of money and benefits.

    Yes, that's illegal for your boss not to do that if you're paid hourly.

    As for this 1 week 2 week 3 week business.......it shouldn't matter.

  6. Yes, it is illegal not to pay you overtime. It is also illegal to split your hours. Basically, he's trying to avoid paying for your benefits as well. If you work 40 hours a week plus overtime, you should be getting benefits as well. By splitting your hours and saying you work 38 or less means your are not a full time employee and don't deserve any benefits of a full time employee.

  9. If you are hourly paid, your are at least covered by Federal and State labor laws, which require payment for additional hours worked. If you are in a union, then they may have negotiated agreements too.
