Is it important to petition for non-disclosure?

I have a class B misdemeanor for shoplifting about 5 years ago and it was ruled no contest and now trying to be a medical assistant and they do background checks and I was wondering if I get a non-disclosure petition and get the record sealed can the hospital still see my arrest?

Even after it is nondisclosed, by TX statute any state licensing board will be able to have access to your criminal charge, so if you are required to be licensed, the licensing board will know about it.  The good news is that you may still get licensed despite your theft charge years ago.  If the hospital specifically asks the state if you have a criminal record then the state will have to tell the hospital, but if the hospital does not ask the state but goes through some private background check agency then you may be able to slip through.
