Question:

Is it joint or sole custody?

I never lived, I never was married and I did not even have a relationship with the man who fathered my child after I found out I was pregnant.

Although he has visitation to my son, and sees him periodically, legally do we have joint custody without papers to back it up, or do I have sole custody of my child without papers to back it up. Please tell me I have sole custody.

  1. so if hes name is on the birth certificate you have joint custody if you want sole custody you would have to do that in the courts

  3. you only have papers if   u got to court u would have sole custody right now if the you fully support child with no child support just depends need a littl emoreon situation

If you were never married and never went to court to arrange custody, you have full custodial rights.  You can stop visitation at any time and deny him overnight privileges if you want (which seems to be the case).  He can sue you for custody though, so if you start denying him rights, be prepared for that.  This is assuming you're in the US.  I'm not sure about other countries.
