Is it legal, in the state of Ohio for an emancipated minor to get married?

My friend gained emancipation in Pennsylvania and moved here in January to live with her boyfriend, who moved here in December because of a job opportunity (Whew!)

She is 17, and he is 19. They have been together for nearly 4 years and have asked me if I know if it is legal for them to get married. They are already living together and doing fairly well money-wise so that really isn't a problem. She is waitressing 30 hours a week, and he works swing-shift at a steel mill making well over 15 dollars an hour.

So my question is, since she is an emancipated minor, and he is over 18, is it legal for them to get married in the state of Ohio, or does she still need to have the parent permission (which she certainly does not have..)

She has been emancipated for several months, now.

  1. Yes, she could legally get married because once emancipated, the law see's her as an adult. You might want to suggest she wait more time, though. People change, sh*t happens, and we're talking about a lifetime here. At 17 & 19 you don't really know if you can be together till death does you part....tell them to wait another 2 years, then if the feelings still the same, go for it! After all, they have a whole lifetime to be together =]


  2. if she is empancipated, then in the eyes of the law, she is a leagal adult and can do as she pleases. Check your state/county website just to sure.

  3. It probably boils down to what her decree of emancipation states.  Unless it specifically states that it gives her the right to marry (and contrary to popular belief, not all emancipation decrees do give the minor that right), she’s probably going to have to have parental consent.  An easy way to find out—call the marriage license office and ask.
