Is it legal for a cop to say he's a sergeant when he is not? part 2?

Question

i asked the officer specifically for a sergeant, my wife was present as well as my two kids in the car. I made a 911 call and asked them for his sergeant or supervisor. 911 as well as the officer said no supervisor was available. Yesterday, We called the precinct and he is a patrol officer. the patrol officer said he was a sergeant and clearly is not. Why lie if everything is on the up and up?

Most likely the officer was acting Sgt for that shift.

If there was no supervisor available that day, it is entirely probable that he was "acting sergeant/supervisor" with the equivalent responsibilities for that day.

It is quite common when the sergeant wants the day off, he appoints one of his officer to act in his stead.  At my department, we call that OIC (Officer In Charge).  But, that varies from dept. to dept.

It also depends on the size of the department and how its broken down geographically.

Z-Force is correct.  Did he say that he was a sergeant or did he say that he was the supervisor or OIC?  It is very uncommon for an officer to claim that he is of a certain rank when his uniform clearly represents that he is not.  The fact that he is a patrol officer has no bearing.  Sergeants can be assigned to some type of administrative duty, depending on the size of the department.  Sergeants can also be assigned to patrol duty.

I don't think they can do that but some states have different laws, but anyways if it didn't kill/injure anyone no point in suing him.  File a complaint, but there could be more circumstances as someone said earlier he could have been the fill in Sergeant or he had not had his rank put on his uniform.

Now hire a lawyer. An officer can not say they are any rank but the one they are.
