  1. Certainly its legal.  As you said in your question, this is just a 'recommendation'.  A doctor is a doctor because he's allowed by law to use independent medical judgment.  Exceeding a recommended dose is more than likely based on that judgment.

Technically, yes it is legal.  The recommendation is for safety purposes, but can be "bent" for reasons the doctor deems acceptable.  If it makes you uncomfortable or nervous, just ask your doctor why he/she has presecribed  it, or you may want to get a second opinion.  Your right.  Never be afraid to ask your doctor questions about your care if you are uncomfortable or nervous about what is going on.
