Is it legal for apartment manager to refuse to show you your background check when she found a felony?

I was rejected because she said the background check showed a felony. I brought

in public records showing no felony and she is keeping my deposit and said I lied on the application. What can I do? It is listed as a misdemeanor. I live in Phoenix Arizona who can I turn to?

  1. Did the lease application say that it was a "non-refundable deposit"?

    If not, she has to give it back.  Otherwise you would have to sue in small claims court.


  2. Was this a deposit or an application fee?

    She probably would have to return a deposit, because no lease occured but she would not have to return an application fee.

  3. It is your legal right to obtain a copy of the background check run on you. Contact the employer and ask which company they ran the background check from, then contact that background check company yourself. They should be able to give you an exact copy of the background check run. Hope this helps!

  5. No, it is her information on you and she is not obligated to show it to you.  She has every right to not rent you the apartment.
