Question:

Is it legal for my insurance to cancel my son's policy because of his ear infections?

I have a family health insurance policy through American Family in Springfield, Missouri. I had my son added on back in oct or nov of 2007 because his mother had his MC+ insurance through the state canceled.. Long story, going through a divorce, i have custody.

Anyways, I was trying to get us on a HSA plan because it would save me about 2 grand a year after everything is said and done. In the process of that, they saw that he had tubes put in because of ear infections. I didnt hide it, they just covered it 3 months ago! So since they turned me down for the HSA, i was going to stay with them until i could find another company.

Well they called today and said that I needed to sign a waver or they would cancel his insurance in 14 days. The waver says that American Family will not cover anything connected with ear infections with my son from here on out.

Is there anything i can do to stop this? Or any legal thing I can use to help make sure my son has insurance?

  2. If I understand your question correctly you currently have an insurance policy but are trying to get a different policy with the same company. If so, when you change policies you are subject to underwriting and yes, they can add a waiver or decline you for the new policy.

    If he has chronic ear infections and the company just found out they can cancel or waiver, even if they previously covered it.

    You can appeal the decision. Each company has an appeals process you must go through but you can take it all the way to your state insurance commissioner.
