    It would be the owner of the property to cut it down if it dies.

  3. They can do what they want to on their property.  If the tree dies then you need to take care of it.

In general, anything on your property is under your control.  If roots come onto my property, I can cut them off.  Trust me, you'd rather I did it than let the roots damage my foundations and have me sue you).  If the branches of the tree come over my fence, I can cut them off, although most places the wood itself belongs to you.  If cutting the branches or the roots damages the tree, that is too bad.  If the tree dies, it's your job to remove it.  Or not, as long as it doesn't become a hazard to neighbors.

    Your alternative is to control your tree or remove it.
