Is it legal in massachusetts to make an employee have two different time cards?

The employer for both jobs is the same, and both jobs give out equal pay. The reason for two timecards is to prevent overtime if the hours of the two separate jobs were totaled each week

  1. on the face value of what you have stated/asked this is illegal but...........

    there are numerous exceptions and exemptions to wage and hour laws

    based on anything thing from the size of the employer to the job duties involved for each effected employee. so what your employer is doing may very well be LEGAL. we do not have the needed information to say for sure. you need to pose this question to the states department of labor.

  2. You state the employer's intent is to avoid paying overtime.  If that's true, it's fraud and other things, and definitely illegal.

  3. If it is the same employer it is definitely illegal. Contact your state labor department.  

  4. I have never heard of this before.  This is a new one.

    I am not sure that this is legal.  You might want to check with an employment attorney.
